This waiver must be completely filled out before engaging in physical activity and applies to all future classes taken or activities participated in or at any of the studios named above. By signing this document, you are agreeing to abide to all the policies and procedures listed below.
I understand that there are risks of physical injury associated with, arising out of and inherent to the activity of dance as well as other physical activity. In recognition of this acknowledged risk of injury, I knowingly and voluntarily waive all right and/or causes of action of any kind, including any and all claims of negligence arising as a result of such activity from which liability could accrue to the Studios or Explore, its officers, instructors, choreographers, guest choreographers, company members, and all affiliated entities. I hereby agree to release Explore and hold Explore harmless of all liability, and hereby acknowledge that I knowingly and voluntarily assume full responsibility for all risk of physical injury arising out of active participation with/for Explore. I am aware that this is a release of liability and an acknowledgement of my voluntary and knowing assumption of the risk of injury. I have signed this document voluntarily and of my own free will in exchange for the privilege of participation.
If any legal action is necessary to enforce the terms of this Agreement, or if it is necessary to employ the services of an attorney to enforce the terms of this Agreements, the party in default or in breach agrees to pay the other party’s reasonable attorney’s fees and court costs in addition to any other relief to which it may be entitled if Customer fails to pay any amounts owing hereunder when due, or otherwise breaches any terms of this Agreement. Customer agrees to pay up to a 40% collection expense incurred by the Studios or Explore in attempting to collect such amounts from Customer, in addition to the aforementioned attorney’s fees and costs.
